Welcome to PublicResourceWay ("we," "our," or "us"). These Terms & Conditions ("Terms") regulate your utilisation of our yacht charter services and website located at publicresourceway.site (the "Service") administered by PublicResourceWay.
By reserving a charter or utilizing our Service, you consent to adhere to these Terms. Should you not agree with any section of these terms, you are not permitted to use the Service.
2. Service Overview
PublicResourceWay offers luxury yacht charter services, which include, but are not limited to:
- Day-long yacht rentals
- Evening cruises
- Company retreats
- Exclusive events
- Extended charters
All offerings are contingent on availability and meteorological conditions. We retain the authority to alter or terminate services at our discretion.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, you must:
- Be at least 18 years of age
- Submit accurate and comprehensive details
- Pay the necessary deposit as indicated in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Confirmation of your reservation occurs only after payment is received and we have provided written affirmation. We have the prerogative to decline service to anyone at our own discretion.
3.3 Availability
Charter bookings are dependent on the availability of vessels and appropriate weather conditions. We endeavor to fulfill your requested dates and timings to the best of our abilities.
4. Payment Terms
4.1 Pricing
All fees are presented in € and incorporate all applicable taxes unless specified otherwise. Prices are subject to modification without prior notification.
4.2 Payment Schedule
- Down payment: 50% of the total charge for the charter required at the time of reservation
- Remaining balance: Due 48 hours in advance of the charter's departure
- Extra fees (if applicable): Payable after the conclusion of the charter
4.3 Payment Methods
We accept principal credit cards, electronic bank transfers, and certified cheques. Our payment processing is secured and encrypted.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours prior to departure: Full refund minus any processing charges
- 24-72 hours prior to departure: Refund of 50%
- Under 24 hours before departure: No refund provided
5.2 Weather Cancellations
Should the weather be deemed unsafe by our captain, we will propose to:
- Reschedule the charter to an alternative date at no extra charge
- Issue a full refund if rescheduling is unfeasible
5.3 Mechanical Issues
If there are mechanical complications with the assigned yacht, efforts will be made to supply a comparable alternative. If this is not possible, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
Every passenger must:
- Comply with the crew's instructions
- Utilize safety equipment when mandated
- Disclose medical conditions that may impact their safety
- Stay within the designated areas on the yacht
6.2 Prohibited Items
The subsequent items are prohibited on board:
- Glass containers
- Illegal substances
- Firearms or any weapons
- Excessive non-alcoholic beverages (beyond reasonable consumption)
- Pets (unless with prior authorization)
6.3 Conduct
Passengers are required to behave in a respectful and proper manner. Charters may be terminated prematurely without a refund if passenger conduct poses a risk to safety or interferes with others' experience.
7. Liability and Insurance
7.1 Our Liability
Our accountability is limited to the cost paid for the charter. We are not held liable for:
- Injuries incurred due to passenger carelessness
- The loss or damage of personal items
- Indirect, consequential, or exemplary damages
- Delays attributable to weather or situations beyond our control
7.2 Insurance Coverage
Rigorous marine insurance that covers our vessels and operations is maintained by us. Passengers should ensure their own travel and personal insurance.
7.3 Assumption of Risk
By participating in our yacht services, you accept that marine undertakings carry inherent hazards and you assume accountability for your safety and health.
8. Modifications and Itinerary Changes
We reserve authority to alter itineraries, journey paths, or schedules due to factors like weather, safety, or operational needs. We will strive to offer a comparable alternative experience.
9. Force Majeure
We are not answerable for postponements, cancellations, or alterations brought about by events outside of our control, including, but not restricted to:
- Extreme weather conditions
- Catastrophic events
- Legal restrictions
- Harbor shut downs
- Unforeseen equipment failures
10. Privacy and Data Protection
Your confidential information is treated in line with our Privacy Policy. By availing of our services, you consent to the assimilation and usage of your data as detailed in our Privacy Policy.
11. Intellectual Property
All materials on our website, such as text, visuals, emblems, and images, are safeguarded by copyright and trademark legislations. Reproducing, disseminating, or creating derivative works without our explicit approval is prohibited.
12. Governing Law
These Terms are regulated by the laws enacted in Ireland. Any disputes will be settled in the courts situated in Dublin, Ireland.
13. Changes to Terms
